Terms and Conditions

Introduction

• Welcome to My RDB Hyundai, a unified Customer Application for Products, services, benefits, features, etc. from RD Motors Pvt Ltd (“RDB Hyundai”, “we”, us” or “our”).
• These Terms and Conditions are the agreement between us regarding use of the Application by you to access to interactive features, digital services, etc., some of which may be provided by third parties and may utilize data collected from you or your Vehicle.
• This agreement is an electronic record under Information Technology Act, 2000 and rules made thereunder as applicable. It is generated by a computer system and does not require any physical or digital signatures.

1. Definitions

• “Application” shall mean the MyHyundai Application including any update, upgrade and enhancement.
• “Bluelink” is a connected car solution that allows Customer to connect to Bluelink System enabled Car from the Device.
• “Car” means any models of Vehicles manufactured, imported, marketed or sold by Hyundai.
• “Customer” means any Individual / Firm / Proprietorship / Company etc. who intend to purchase or is interested in booking Car.
• “Member” means a Guest/Visitor or Prospect or Customer, who is at least 18 years of age and competent to enter into a contract.
• “Service Provider” means an Agency or third party engaged by Hyundai for providing any information, communication, or facilities.

2. Registration

• A Guest/Visitor can visit/log-in without sign-up but will have limited access to features.
• New Users need to sign up with Google or follow the registration process specified in the Application.
• Existing CTB and/or MMP users can log-in using their existing User ID and Password.

3. Limit to Members

The Application can be viewed anywhere in the world but is intended for use only in India. All pricing information referred to in the Application is in Indian currency.

4. Conditions of Use

• You will use the Application solely for your own personal, private, non-commercial use.
• Hyundai or a Service Provider may collect subscription fees for certain features.
• You are responsible for any charges from your Wireless Carrier.
• You must comply with all applicable laws, rules, and regulations while using the Application.

5. Licence

• You are granted a limited, non-exclusive, non-transferable, royalty-free license to use the Application.
• You may not alter, modify, copy, reproduce, reverse engineer, or decompile the Application.
• You may not remove or tamper with any proprietary notices or labels.
• You may not use the Application for any unlawful or criminal activity.

6. Shopping & Payments

• Some links may offer e-commerce opportunities from Hyundai or third parties.
• You are solely responsible for charges owed for goods and services purchased.
• You warrant that any payment information you supply is true, correct, and complete.

9. SERVICE & Online Payments

• Customer can make payment for repair bills through the payment gateway to the Dealership.
• Hyundai is only a facilitator in the transaction and is not responsible for any losses arising from the payment transaction.
• Any refunds will be made by the Dealership to the original account/card used for payment.

13. Links to Third Party Sites

Hyundai does not control the availability and content of outside services and resources linked in the Application. Inclusion of such links does not imply endorsement.

14. Access & Security

You are solely responsible for maintaining the confidentiality of your password and account. Hyundai will not be liable for any loss incurred due to unauthorized use of your account.

19. Disclaimer of Warranties

The Application is provided "as is" and "as available". Hyundai disclaims all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

20. Termination

Hyundai may terminate or suspend the use of the Application if the Member fails to fulfill obligations or breaches the Terms and Conditions.

22. Limitations of Liability

In no event shall Hyundai or its Service Providers be liable for any direct, indirect, special, punitive, or consequential losses arising out of the use of the Application.

24. Resolving Disputes

• Any dispute relating to these terms shall be subject to Arbitration of a Sole Arbitrator appointed by HYUNDAI.
• The venue of Arbitration shall be at Chennai.
• The terms shall be governed by the laws of India, with exclusive jurisdiction in the Courts of Chennai.

25. General

Hyundai reserves the right to modify or alter the contents of the Application or these terms at any time without prior notice by posting changes on the Application.
